Vermont Business Magazine Attorney General TJ Donovan is supporting efforts to combat the gender pay gap. AG Donovan joined an amicus brief in support of the City of Philadelphia in a lawsuit regarding a statute aimed at addressing the gender pay gap. The brief was filed with the U.S. Court of Appeals for the Third Circuit. The challenged ordinance prohibits employers from either asking a prospective employee about salary history (known as “the inquiry provision”) or relying on salary history in determining future salary (known as “the reliance provision”). The lower court found that the reliance provision was constitutional but that the inquiry provision violated the First Amendment. The decisions as to both provisions are on appeal.
“Women deserve equality and fairness,” said Attorney General Donovan. “The gender pay gap hurts women and families, and we must do everything we can to address it.”
In Vermont, women experience a wage gap of 16 cents on the dollar as compared to men. According to the Vermont Commission on Women, women make up 45% of Vermont’s full-time workforce, and 43% of women working full-time do not earn enough to meet basic expenses.
In addition to Attorney General Donovan, the amicus brief was joined by the Attorneys General of Connecticut, Delaware, District of Columbia, Illinois, Massachusetts, New Jersey, New Mexico, New York, Oregon, Puerto Rico, Virginia, and Washington.
